TERMS OF USE

These Terms of Use apply to the www.pope-pm.net website (the “Platform”), as well as to the associated Member Area and other related websites (collectively the “Service”).
These Terms of Use constitute a legally binding document that expresses our expectations of the users (“You” or “User”), as well as our obligations as operators of the website www.pope-pm.net (“We”) as well as the relationship of users to each other describes.
“Content (s)” hereby describes texts, educational materials, images and videos that are available on the platform under Creative Commons CCBY. The term “image (s)” includes photos, vector graphics, drawings and illustrations. “Video (s)” means moving images, animations, footage and other audiovisual content. “Text (s)” includes the explanations of the didactic concepts provided on the Platform. “Teaching material (s)” contains files which are available for free download in pdf format.
The operators of the platform can adapt these conditions at any time and without notice. The date of the last change is mentioned at the top of this page. By continuing to use the users give their consent to the changes made.
Requirements for use and cooperation
The content provided on the website may be used free of charge by users according to the terms of the Creative Commons CCBY.
Additional services (e.g., a communication platform with other lecturers, teaching materials in .doc, .ppt, .xls format) will be provided to you if you provide content yourself according to these Terms of Use. However, we only accept content from people who teach project management in secondary schools and higher education institutions (see section “Upload content”).
Use of content of the platform
All content provided is public domain according to the terms of the Creative Commons CCBY. As far as legally possible, all copyright and related rights to the content have been assigned by the authors. The content may be used, modified or unmodified, free of charge for commercial and non-commercial applications in digital or printed form, with reference to sources.
Please note:
- For images of identifiable persons, logos, trademarks and other objects may – especially for commercial use – a separate permit (photograph permission or model contract) may be required.
- Recognizable persons shall not be misrepresented or displayed in a manner that is perceived as offensive by the presentation – unless specifically authorized. In addition, the contents may not be used without separate permission to suggest advocacy or endorsement of products or services by persons, brands, organizations, etc. shown on the image.
- Data mining, scraping and other use of programs for automatic data collection and / or extraction of digital data is strictly prohibited. Bulk copying of content is strictly prohibited unless explicit permission has been granted by us. This applies to all content on the platform, including the texts, materials, images and videos published under Creative Commons CCBY. The compilation of the content is copyrighted as a collective work in accordance with international conventions and intellectual property laws.
Upload content
We only accept content from people who teach project management in secondary schools and higher education institutions.
You can provide content for the platform yourself after contacting us. You will then be provided with the uploading guide. We check the suitability of the content for use on the website.
By making content available, they will get public domain under the terms of the Creative Commons CCBY. Copyright owners of uploaded content grant an unrestricted right of use to anyone, as long as the source is specified. Each author must provide information about the correct source during the upload process. The name of the (high) school can be mentioned on this online platform. Persons who are also for other private or public organizations may not include the name of their organization in the material provided as commercial advertising on this platform is prohibited.
This right of use applies regardless of place and time and is irrevocable. The licensor cannot revoke these freedoms as long as the user adheres to the license conditions.
The right of use was explicitly or conceded – due to an even more extensive, in Germany and Austria but not legally possible transfer to the public domain or the legally also not possible declaration of own works as public domain – conclusive. In Switzerland, it is possible to waive its copyright, which extinguishes copyright on the work in question.
You are responsible for the content you provide and you warrant that you have all the rights to this content that is required for worldwide, free, irrevocable, and indefinite use and, if so permitted by law, assign and / or distribute it. These include licenses and rights of third parties.
The platform does not permit content that violates copyrights, property rights, trademark rights, other legal regulations or rights of third parties as well as morality.
Although we strictly ensure that uploaded content is not misused or used contrary to our terms of use, unfortunately we cannot guarantee this and in the given case also not be held responsible.
We reserve the right to delete any content on our platform at any time. This applies in particular to defective files and legally problematic content.
Change and termination
We inform all registered users about changes of our terms of use. Each author has the right to object to the changed terms of use. The content provided by this author will be deleted afterwards.
We reserve the right to terminate the license agreement at any time and without giving reasons and to prohibit further use of the platform.
Indemnification
Users release the Platform from any claims that third parties assert against the Platform for infringement of their rights by content posted by the User on the Platform or by any other use of the applications available through the Platform. The user hereby assumes the costs of a necessary legal defense of the platform including all legal fees and lawyers’ fees at the statutory rate. This does not apply if the infringement is due to no culpable behavior of the user.
The User is obliged to promptly, truthfully and completely disclose to the Platform, in the event of a claim by third parties, all information available to him / her which is necessary for an examination of the claims and a defense. Further compensation claims from the platform towards the user remain unaffected.
Data protection
Personal data that you submit to us for uploading content is processed and stored by us for the purpose of operating the www.pope-pm.net platform. In the course of uploading content, the name of the user is published, the publication of the school or university is only on the basis of your consent. This consent may be withdrawn at any time without giving reasons by written notice to us, but this does not affect the lawfulness of the publication of the name of the school or university until that date.
Any further disclosure of your personal data will not take place.
The information you collect will be processed by us only as long as necessary to achieve the above purpose and as required by applicable law. In any case, we store the data provided by you until the expiration of limitation periods of potential legal claims or as long as this requires statutory storage requirements.
Under current law, you have the right to your personal information
- information, correction or deletion, limitation of processing, opposition and data portability. These rights can be asserted at the University of Applied Sciences BFI Vienna, Wohlmutstraße 22, A-1020 Vienna, datenschutz@fh-vie.ac.at.
- on a complaint that can be asserted with the competent supervisory authority (in Austria: Austrian Data Protection Authority).

Applicable law
On the contract ration between the users and the platform is governed by Austrian law. As far as permissible, the place of jurisdiction is Vienna.
Severability clause
Should individual provisions of these Terms of Use be wholly or partially invalid or lose their legal validity later, the validity of the Terms of Use shall not be affected.
Use of this platform requires compliance with these Terms of Use. By accessing, browsing, and / or using this platform, you acknowledge that you have read and agree to comply with these Terms of Use and applicable laws and regulations.
